1. Acceptance of Terms
By accessing or using RKJ Media Marketing's website, scheduling platform, or services, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Service
RKJ Media Marketing is a pay-per-qualified-lead agency that generates, screens, and delivers brand-exclusive booked estimates to home-service contractors (HVAC, roofing, artificial turf, solar, remodeling, and related trades). Specific deliverables, pricing, and qualification criteria are defined in your individual service agreement.
3. Client Responsibilities
Clients are responsible for staffing to call back leads quickly, honoring appointments, providing truthful information about service offerings and service area, complying with all applicable laws (including TCPA, CAN-SPAM, and state contractor licensing), and reporting lead outcomes promptly so the qualification process can be calibrated.
4. Lead Qualification & Replacements
We deliver leads that meet the qualification criteria agreed to in your service agreement. Leads that do not meet those criteria may be eligible for replacement when reported within the disputed-lead window defined in your agreement. We do not guarantee close rates, contract value, or revenue — those depend on your sales process.
5. Billing & Payment
Clients are billed per qualified lead or per booked appointment as specified in their service agreement. Invoices are due upon receipt unless otherwise agreed in writing. Failure to pay may result in pause or termination of lead delivery.
6. Exclusivity
Leads are delivered exclusively to one contractor per service area and trade for the duration of the engagement. We do not resell or share leads with competing contractors in your market.
7. Intellectual Property
Ad creative, landing pages, scripts, funnels, and systems we build remain the property of RKJ Media Marketing unless transferred in writing. You retain ownership of your brand assets, trademarks, and business data.
8. Limitation of Liability
RKJ Media Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, lost profits, or lost business opportunities resulting from your use of our services. Our total liability for any claim is limited to the fees you paid us in the preceding 30 days.
9. Termination
Either party may terminate the engagement in accordance with the notice terms in the service agreement. Outstanding invoices for delivered leads remain due upon termination.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the new Terms.
